peopleHum (“peopleHum” / “PeopleHum” / “we” / “our” / “us” ) are committed to protecting and respecting your privacy. This policy sets out the basis on which we will process any personal data we collect from you or that you or your employer provides to us through your use of the peopleHum online software platform and the accompanying software App (together the “Platform”). Please read this policy carefully to understand our views and practices regarding your personal data and how we will treat it. EMPLOYER AGREEMENT
peopleHum has entered into an agreement (“Employer Agreement”) with your employer to grant you access to the Platform and/or the various modules available on the platform. The data generated/uploaded by you to the platform would be governed by the employer agreement for the purposes of the Data Protection Laws. The existence of your record on the platform would be governed by the “employer” who has entered into an agreement with us and your contractual status with that entity would not characterize your data policies.

We will collect and process the following data about you:
USAGE OF THE INFORMATION COLLECTED
We are permitted by the Employer Agreement to collect any of the data, either directly from you or from any of the sources listed above for use and/or disclose as well as perform additional processing on this data. All of this would be exclusive of the personal data.
We as a platform, will not execute or undertake any exercise that would have reference to any of the special categories of personal data -
We may choose to use any data from you and other employees in an aggregated and anonymous fashion for generating statistics and benchmarks as well as to outline comparisons with other organizations.
Disclosure of data
Your personal data could be shared/used with other companies/partners in our group. We may also share your personal information with selected third parties in accordance with this policy, including service providers, for example of IT services, business partners, suppliers and/or sub-contractors, for the performance of any contract that we enter into with your employer (such as the Employer Agreement), including -

Except as explained above, we will not disclose your personal data to any third parties for any other purpose unless we have a legal right or obligation to do so.
We require our service providers to comply with data protection laws whenever they process your personal information and not disclose your data to third parties without our express consent.
HANDLING OF INTERNATIONAL DATA
The information that we collect from you may be transferred to, processed and stored at, a destination outside the European Economic Area ("EEA") where required to support certain models and features of the Platform and/or to fulfil obligations in the Employer Agreement.
We will take all steps reasonably necessary to ensure that your personal data is treated securely and in accordance with this privacy policy.
INFORMATION SECURITY
You will for the most part required to use a username and password or authenticate yourself using one of Google/Slack/O365, to access most of the functionality on the platform. There could be some functionality, as configured/setup by your employer which would be available without a password. You are responsible for keeping your access credentials confidential. You must not share these details with anyone, or store them in a way that may allow a third party to access them.
We maintain appropriate technical and organizational measures to ensure that an appropriate level of security with respect of all personal data we process. Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to the Platform and you acknowledge that any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features which are appropriate to the type to personal data you have provided to try to prevent unauthorized access or inadvertent disclosure, which may include two-factor authentication and end-to-end encryption.
CUSTOMER SUPPORT ACCESS
By default, peopleHum is granted login access to the Customer Account for initial onboarding, troubleshooting, and support. This access can be disabled/enabled by the Customer at any time through account settings. The Customer acknowledges and grants peopleHum the rights necessary to provide such support access. It is recommended that the Customer disables this access promptly upon completion of onboarding or resolution of any such support issue.
YOUR CONSENT TO THE POLICY
For some of the uses of your information described above, there is a legal basis under applicable data protection laws for us to use the information without your consent. This includes, for example, where it is necessary for us to use the information in order to provide the Platform to you or where we have a legitimate interest to use it by virtue of the relationship between you and us when providing the Platform to you (for instance, for troubleshooting, data analysis, testing or research purposes). Where this is the case, this privacy policy fulfils our duty to process information fairly and lawfully and in a manner that you would expect given the nature of our relationship with you. This includes giving you appropriate notice and explanation of the way in which your information will be used.
Where consent is required for our use of your information, by ticking the appropriate consent box or otherwise communicating your consent to us (whether by phone, email or other means), you consent to our use of that information as set out in this policy. If you disclose someone else's information to us, you confirm that you have their consent to disclose this information to us and for us to use and disclose it in accordance with this policy.

We will retain the personal information we receive and collect about you for a period of 2 years.
